News » 27.08.2025 - NL: Court orders neighbor to compensate grower for greenhouse damage

In East Brabant, the Netherlands, two neighbors have been locked in a dispute over poorly maintained vegetation. The conflict escalated when a tree toppled over in January 2022, damaging a greenhouse. After consulting an independent damage expert, the court has now ruled that the neighbor who owned the fallen tree must pay for the damage. If he fails to do so, he faces a penalty that could rise to €25,000.

The court also ordered the neighbor to remove part of the overgrown trees on his property, prune others to prevent further risks, and deal with the nuisance caused by a particularly invasive Ailanthus altissima (commonly known as the tree of heaven). The ruling, issued by the District Court of East Brabant on 16 July, gives the neighbor between four and six months to take action.

The two plots involved once belonged to the same owner. One is now used for greenhouse horticulture, while the other holds a former company residence. Due to zoning restrictions, the house may no longer be rented out. Relations between the current neighbors are strained, with accusations of harassment and ongoing disagreements over an easement. This easement allows the grower to access and maintain his greenhouse via the neighbor's land, which has been another source of conflict.
